1. What is the new General Data Protection Regulation (GDPR), who does it apply to and what is Ritchie Bros. doing about it?

The GDPR is a new European data protection law which sets out various requirements that will become effective on May 25, 2018.  It replaces the existing data protection regime for the EU under Directive 95/46/EC, and is intended to harmonize data protection laws throughout the EU by applying a single data protection law that is binding throughout all Member States.  The GDPR applies to virtually all organizations that process the 'personal data' of natural persons in the EU as a result of services offered to them or which monitor them, regardless of whether the organization physically resides in the EU.  Personal data is any information related to an identified or identifiable natural person.

Ritchie Bros. remains committed to being transparent about how we handle and use personal data.  We continue to take seriously our obligation to safeguard your personal data and to process it responsibly.  We have been and will continue to diligently work to ensure we are prepared to meet our obligations under GDPR and other data protection laws.  We recognize the importance of these laws to our customers in the delivery of our products and services to them.  If you have further questions, please contact our Data Protection Officer at dataprotection@ritchiebros.com.

2. How is my information shared within the Ritchie Bros. organization?

Ritchie Bros. operates multiple distinct, complimentary, multi-channel brand solutions that allow us to meet the needs and preferences of a wide spectrum of equipment sellers and buyers. From time to time, we will make information that we possess about you available to other brands in the Ritchie Bros. family to pursue our legitimate interest to improve our collective products and services and better understand our industry.  We also have a legitimate interest in protecting the integrity of our selling solutions by sharing information to prevent fraud and monitor our networks and systems. We may also share your information where it is necessary for us to perform the services or supply the products you've contracted with us to perform or supply.  Sometimes we also share the information internally to comply with our legal obligations.  More information can be found in our Privacy Statement.

3. Will I receive communications from each Ritchie Bros. brand solution?

Depending on the marketing preferences you've communicated to us, a brand may make you aware of the products and services offered by others in our family of brand solutions and that are available to you as a Ritchie Bros. customer.  You may unsubscribe from further communications at any time; just follow the instructions set out in the communication or contact us at csg@rbauction.com for further instructions.

4. Does Ritchie Bros. provide information to OEMs and their dealers and service providers?

In some cases, we will enter into an arrangement with an original equipment manufacturer (OEM), such as Caterpillar, and their dealers and service providers to share information when you bid on or buy their equipment. We provide you with the right to know who we have shared your identifiable information with for their use and to opt-out.

To obtain a list of these OEMs, OEM dealers or service providers who we have shared your identifiable information with in the last year, please contact us at dataprotection@ritchiebros.com, attention: Data Protection Officer or by mail at 9500 Glenlyon Parkway, Burnaby, British Columbia, V5J 0C6.

When we share information with OEMs and their dealers and service providers, your information will be governed by the privacy policies of the other companies and will be subject to the laws of the place in which the OEM processes or their dealers and service providers process the information. You can opt-out of us sharing your information with the OEMs and their dealers and service providers. Please contact us at OEMoptout@rbauction.com.

5. Why does Ritchie Bros. provide information to OEMs and their dealers and service providers?

We partner with certain approved OEMs and OEM dealers to provide them with information about the secondary market for their equipment. OEMs and OEM dealers use this information to understand the lifecycle of their equipment. In addition, we partner with these OEMs in the pursuit of our common legitimate interests so that the OEMs and their dealers and third party service providers can offer better services to you, including more timely and relevant information on available warranties and parts. For example, if you bid on equipment at one of our auctions, we may share that information with a local approved OEM dealer or service provider so that the dealer or service provider can assist you with similar equipment or your maintenance and replacement parts needs.

6. Do I have to deal with OEMs and their dealers and service providers?

You are not required to purchase any products or services. If an OEM, OEM dealer or service provider reaches out to you to communicate about their products and services, it's your choice whether you are interested in hearing more. If you choose to provide them with additional information that may be requested, that information will be handled by them for the purposes disclosed in their privacy policies.

7. Does Ritchie Bros. provide my information to other companies outside its organization to use?

We may provide information to other select and approved companies to use. Except as disclosed in our Privacy Statement or this FAQ we de-identify your information before we share it. For example, we may share statistics on equipment purchases or bids with third parties for their use in understanding the market for equipment. 8. Does Ritchie Bros. use third party service providers?

Like most companies, we outsource some of our functions to third party service providers. In order to operate our business and deliver our products and services to you, these third party service providers will have access to your information. For example, we use third party service providers to manage our customer email lists. When we use third party service providers who help us support our business operations, we use contractual and technological means to require those service providers only to use the information we provide to them to deliver our products and services – not for their own use.

Other service providers that partner with us to deliver our products and services only receive your information if you request further details about or purchase the products and services. For example, your information will be shared with financial institutions and other lenders when you apply for and accept financing for your equipment purchases. When we provide your information to these service providers, your information will be governed by the privacy policies of the service provider. While we are not responsible for the privacy practices of these providers, we carefully select our providers to ensure they have information security practices and procedures in place that meet or exceed our own. However, any issues or questions you have should be raised with the service provider directly. 9. Is my information transferred and stored abroad in international locations?

Ritchie Bros. is a global organization. Information that our brands collect online, at auction sites or by other means is transferred to central databases that are currently located in Canada, Europe and the United States, but may also be transferred and stored in other countries. For instance, your information may be stored at or accessed from any location in which Ritchie Bros. or its service providers have operations which may not be where you reside. Your information will be subject to the laws of those other jurisdictions, which may be different than your country of residence. To protect your personal information, we use contractual and technological means designed to mitigate the threat of unauthorized access, use or disclosure of your information, and where appropriate, to ensure there is a lawful basis for the initial transfer or onward transfer of the information.  To obtain more information about these safeguards contact our Data Protection Officer at dataprotection@ritchiebros.com.

10. Does Ritchie Bros. obtain information from telematics devices installed in equipment?

Some equipment that we sell may contain telematics devices that transmit information about the location, use and performance of the equipment to the OEM or the telematics provider. Please consult the equipment specifications and conduct your own review of the equipment before purchasing. Information that is collected through these telematics devices is subject to the privacy statement of the telematics service provider or the OEM. If the telematics service provider or OEM is permitted to do so, we may receive some information from the telematics service provider or OEM regarding the equipment after you have purchased and taken possession of it. For example, we may receive information regarding the destination location of the equipment for a period of time after it has been transferred to you. We use this information to better understand the needs of our customers, including where equipment is required, in accordance with our Privacy Statement.

11. Who should I contact if I want to exercise my personal data rights or understand more about Ritchie Bros.' handling of my personal data?

GDPR and other data protection laws may give you certain rights to object to or restrict the processing of your personal data (any information related to an identified or identifiable natural person).  It may also give you the right to request categories of information detailing who, where, why, how, and for how long Ritchie Bros. is or will process your personal data.  If the personal data we are processing is inaccurate or incomplete, you may request that we rectify the incorrect or missing data.  In certain circumstances, you may have the right to request that we erase your personal data from our systems or to obtain a copy of the data you provided to us and that is in our possession.  For more information on exercising these rights or making a complaint about our practices, please contact our Data Protection Officer at dataprotection@ritchiebros.com.  If you wish to make a complaint to a supervising authority or other regulator, please let our Data Protection Officer know and we can direct you to the appropriate supervisory authority or regulator.  Note though that if you reside in the European Economic Area, Ritchie Bros.' lead supervisory authority is the Dutch Data Protection Authority.
